HB 293/LM (BR 1298) - D. Owens, R. Bunch, M. Denham, D. Horlander, J. Jenkins
AN ACT relating to elections and declaring an emergency.
Amend KRS 117.265 to provide that in the case of a special election for a vacancy in either house of the General Assembly administered under KRS 118.730, a declaration of intent to be a write-in candidate shall be filed at least 28 days before the day of the election; amend KRS 118.730 to provide that if a writ of election has been issued to fill a vacancy in either house of the General Assembly and only one candidate has qualified for the vacancy, the county clerks in the territory in which the election is to be held shall conduct voting in only one of the following: the county clerk's office or another place designated by the county board of elections and approved by the State Board of Elections, and provide that this section shall not apply if the writ of election calls for the special election to be held on the day of a primary or general election or the same day as any other special election, except an uncontested special election to fill a vacancy in either house of the General Assembly; amend KRS 118.740 to require that the sheriff of each county in which a special election is to be held shall give notice at least 28 days before the day of the election, and if a special election to fill a vacancy in either house of the General Assembly is administered under KRS 118.730 and only one candidate qualifies for the vacancy, the notice shall include the location of the election; amend KRS 118.770 to provide that when a writ of election or proclamation is issued to fill a vacancy as prescribed under KRS 118.710, 118.720, or 118.730, independent, political organization, or political group petitions and certificates of nomination shall be filed at least 28 days before the day of the election; EMERGENCY.
