HB 284/LM (BR 199) - R. Damron

     AN ACT relating to traffic safety.
     Amend KRS 189.125, relating to required use of seat belts, to provide that seat belts are not required to be installed on off-road vehicles and vehicles which are not required to have seat belts installed pursuant to federal law; provide that commercial vehicle drivers making frequent stops, emergency vehicle operators and passengers, persons in custody of law enforcement, persons who cannot fasten a seat belt or shoulder strap because the seat belt or shoulder strap is too short, and persons under five feet four inches tall are exempt from the seat belt requirement; provide for the Transportation Cabinet to issue identification stickers for persons with medical or height excuses; provide for protection of persons against multiple prosecutions if charges are dismissed or the person has been found not guilty.

HB 284 - AMENDMENTS


     HCS/LM - Retain original provisions, except eliminate seat belt exemptions for height, drivers of emergency vehicles, and drivers of commercial motor vehicles; amend KRS 189.990 to fix the fine for seat belt violation at $25; clarify language exempting fines for seat belt violations from any and all court costs.

     HFA (1, J. Vincent) - Retain provisions of the HCS, except delete language making a decision of dismissal or acquittal based on the finding of a valid medical excuse binding on all peace officers, county attorneys, and courts in the Commonwealth; replace with language specifying that such a dismissal or acquittal shall be prima facie exculpatory evidence in any court in all jurisdictions.

     SCS/LM - Retain original provisions of bill, except for that portion relating to an identification sticker for persons with medical or height excuses; insert provisions amending the DUI law to lower the blood alcohol level for an aggravating circumstance from 0.18 to 0.15; revise the standards for the issuance of a hardship license when the aggravator is present; insert a provision amending KRS 146.241 relating to the wild river system to include a reference to I-66.

     SCA (1/Title, R. Stivers II) - Make title amendment.

     SCA (2/Title, R. Stivers II) - Make title amendment.

     SCA (3, R. Stivers II) - Insert provisions to amend KRS 177.010 to include airport runways within the definition of "public highway" and to include an appropriation for $9,000,000 as matching funds for a runway project at the Lexington airport.
