     AN ACT relating to cooperatives.
     Amend KRS 279.020, relating to incorporation of a rural electric cooperative corporation, to allow a nonprofit cooperative corporation to be organized for the primary purpose of generating, purchasing, selling, transmitting or distributing electric energy and providing any good or service related to generating, purchasing, selling, transmitting, or distributing electric energy and for the secondary purpose of engaging in any other lawful business or activity.


     HCS - Retain original provisions of HB 568; in addition, make nonprofit cooperative corporations of rural electric cooperative corporations organized for the purpose of engaging in business other than electric energy conduct their business through an affiliate, unless the nonprofit cooperative corporation is engaged in a contract with a federal military installation or a contract for administrative services with a local, state, or federal government; establish the affiliates to nonprofit cooperative corporations engaged in nonregulated business; provide annual reports to member-owners of the cooperative and balance sheets and income statements to the Public Service Commission.

     HFA (1, F. Rasche) - Retain original provisions; make telecommunications infrastructure services a primary purpose for the organization of a nonprofit cooperative corporation.

     HFA (2, J. Bowen) - Require cooperatives that would compete with existing nonenergy private enterprise to receive PSC approval after demonstrating a market need.
