HB 86/LM (BR 65) - C. Hoffman, R. Wilkey, M. Marzian, R. Palumbo, T. Riner
AN ACT relating to traffic regulations.
Amend KRS 189.125, regarding seat belts, to allow primary enforcement of the mandatory seat belt law, exempt operators or passengers for which the seat belt does not fit to NTSHA and manufacturers' specifications; prohibit the inclusion of a conviction for a seat belt violation as part of a person's driving history record; amend KRS 189.990 to specify the fine for violation of the mandatory seat belt law may be prepaid, and if prepaid the offender does not have to pay court costs; amend KRS 431.452 to conform; create a new section of KRS Chapter 189 to prohibit law enforcement agencies from erecting roadblocks for the sole purpose of checking for violations of the seat belt law; require the Transportation Cabinet to erect signs on the interstate system notifying motorists of the requirement to use seat belts on the Commonwealth.
HB 86 - AMENDMENTS
HCS - Retain original provisions with the following exemptions: amend Section 1 to exempt individuals who cannot properly fasten a seat belt; amend Section 4 to prohibit road blocks for the sole purpose of enforcing any provision of KRS 189.125; add a new section 6 to delay enforcement of the provisions of seat belt law until January 1, 2007, require the officers issue a courtesy warning rather than a citation for a violation of KRS 189.125(6) until January 1, 2007.
HFA (1, J. Stewart III) - Exempt from the seat belt requirement any vehicle manufactured after 1985.
HFA (2, R. Wilkey) - Delete delayed enforcement provisions; declare an EMERGENCY.
HFA (3/Title, R. Wilkey) - Make title amendment.
HFA (4, J. Stewart III) - Exempt operators and passengers of vehicles twenty years old and older from seat belt requirement.
HFA (5, J. Stewart III) - Reduce fine for seat belt violation from a $25 maximum to a $5 maximum.
HFA (6/P, R. Nelson) - Attach provisions of HB 105.
HFA (7/Title, R. Nelson) - Make title amendment.
HFA (8, J. DeCesare) - Amend Section 4 to provide that a citation for a violation of KRS 186.125 shall not be issued to a person at a roadblock unless the person is cited for another offense.
HFA (9, H. Collins) - Delete the committee substitute and all previously adopted floor amendments in their entirety and replace with the provisions of the original HB 86 with the following exceptions: amend Section 1 to apply the provisions of the seat belt requirement to vehicles manufactured after 1981; remove exemption in the original bill for individuals who cannot properly fasten a seat belt; amend Section 2 to exempt all fines, not just prepaid fines, for violations of KRS 189.125(6) from court costs; amend Section 4 to prohibit road blocks for the sole purpose of enforcing any provision of KRS 189.125; add a new section 6 to delay enforcement of the provisions of seat belt law until January 1, 2007; require the officers to issue a courtesy warning rather than a citation for a violation of KRS 189.125(6) until January 1, 2007.
