AN ACT relating to family military leave.
Create new Sections of KRS Chapter 337 to define terms; provide up to 5 days of unpaid family military leave for firms that employ 15 to 50 employees; provide for up to 10 days of unpaid family military leave for firms that employ more than 50 employees; require advance notice of intention to take leave; prohibit the taking of family military leave until other types of leave are exhausted, except for sick and disability leave; require that employers to restore employees to their old position or an equivalent position upon returning from family military leave; require employers to continue benefits at the employee's expense; permit an employer and an employee to negotiate to maintain benefits at the employer's expense; provide that taking military leave shall not result in the loss of benefits, shall not affect collective bargaining agreements, and shall not diminish contract rights; prohibit a person taking family military leave from losing benefits before taking leave, from losing collective bargaining agreements or benefit plans, from having family military leave diminished, or from having contract rights or seniority status diminished; prohibit employers from interfering with family military leave rights, and from taking action against an employee who exercises leave rights; provide for civil actions in circuit court to enforce the Act.
