SB 20 (BR 24) - T. Buford

     AN ACT relating to certification of phlebotomy technicians.
     Create a new section of KRS Chapter 333 to prohibit a person from performing venipuncture or skin puncture for medical laboratory testing during the remainder of 2005 unless the person works under specified medical supervision and has received designated training; require on and after January 1, 2006, Act that a person performing venipuncture or skin puncture has two years to complete the specified requirements to obtain certification as a phlebotomy technician; require the Department for Public Health to promulgate an administrative regulation specifying the requirements for certification and recertification that shall include, at a minimum, that the applicant be certified as a phlebotomist by a national accreditation agency, have completed specified education, training, and experience, and produce a statement of competency from a specified supervisor; permit waiver of certain training requirements for persons with specified experience; require continuing education; require department to charge fees of no more than $25 for certification and recertification; permit the department to issue a certificate to persons who only perform skin punctures for test purposes; provide that the section shall not apply to a licensed or certified health care worker acting within the scope of his or her license or certification.
