SB 175 (BR 1470) - R. Stivers II
AN ACT relating to the issuance of federal permits by the Natural Resources and Environmental Protection Cabinet.
Amend KRS 224.16-050, relating to the Federal Water Pollution Control Act, to allow the Natural Resources and Environmental Protection Cabinet to issue permits for the discharge of fill material into streams and wetlands; require the cabinet to enter into a memorandum of understanding with USDA prior to assuming such authority; permit the cabinet to charge a fee for processing permit applications.
SB 175 - AMENDMENTS
SFA (1, E. Scorsone) - Require the Natural Resources and Environmental Protection Cabinet to report and make recommendation to the Governor on requesting approval by the U.S. EPA for state administration of the federal Clean Water Act, Section 404 program; require any state 404 water program to provide for review comparable to National Environmental Policy Act and public interest review.
HFA (1, T. Riner) - Change Section 1 to amend KRS 224.16-050 to provide that the cabinet shall not impose under a permit issued pursuant to the section any effluent limitation, monitoring requirement, or other condition which is more or less stringent than federal requirements.
HFA (2, T. Riner) - Require the cabinet to complete a feasibility study that demonstrates it can administer the 404 water permit program without additional funding and that the program will be as protective of public health, safety, and the environment as if the program remained under federal administration.
HFA (3/P, R. Nelson) - Attach provisions of HB 172/HCS.
HFA (4/Title, R. Nelson) - Make title amendment.
HFA (5/P, R. Nelson) - Provide that Department of Agriculture reauthorize the Forest Health Task Force; provide that state government agencies furnish State Entomologist with information; provide that State Entomologist submit report to General Assembly.
HFA (6, R. Meeks) - Provide that the cabinet shall report no later than January 1, 2006 on costs, personnel, and other changes needed to support state assumption of the permitting program under 33 U.S.C 1344 (e) and (g).
