SB 122 (BR 1160) - B. Guthrie

     AN ACT relating to surgical assistants.
     Amend various sections of KRS 311.864 to 311.890 regarding surgical assistants to exempt from certification attending physicians and hospital supervisors who oversee surgical assistants; increase membership in the Advisory Committee for Surgical Assistants from six to seven by including one representative from the Kentucky Board of Medical licensure; accept continuing education guidelines from the Commission on Accreditation of Allied Health Education Programs and delete language regarding other national associations for surgical assisting; extend the grandfather provision from 2005 to 2008 and allow practicing surgical assistants who can demonstrate to the board's satisfaction proficiency in procedures deemed necessary by a delegating physician to be certified; require applicants after June 30, 2008 to hold and maintain national certification from one of three accrediting sources; and create a new section of KRS 311.864 to 311.890 to allow the board to issue temporary six-month certificates to qualifying individuals.

SB 122 - AMENDMENTS


     SCS - Retain original provisions of bill, except amend KRS 311.864 to include definitions for "certified surgical assistant" and "intraoperative surgical care"; delete "perioperative" and add "intraoperative" as the registered nurse member of the Advisory Committee for Surgical Assistants; extend the grandfather provision from 2005 to 2006; delete language allowing a surgical assistant who can demonstrate proficiency to become certified; require completion of a program accredited by the Commission on Accreditation of Allied Health Education Programs (CAAHEP) for certification after June 30, 2006.

     HCS - Retain original provisions and add sections to amend KRS 314.011 to authorize advanced registered nurse practitioners to prescribe controlled substances; limit the prescribing of Schedule II controlled substances written by an advanced registered nurse practitioner to a 72 hour supply; amend KRS 314.042 to require an advanced registered nurse practitioner to enter into a written collaborative practice agreement with a physician that defines the scope of the prescriptive authority prior to prescribing controlled substances; amend KRS 218A.010 to include an advanced registered nurse practitioner within the definition of "practitioner" and include an advanced registered nurse practitioner as a provider authorized to order a drug or medicine; and amend KRS 218A.202 to authorize the Board of Nursing to receive reports from the electronic system for monitoring controlled substances under specified circumstances if the nurse is working in a practice where a physician or another advanced registered nurse practitioner is under investigation or if the nurse working in a designated geographic area where inappropriate prescribing may be occurring.

     HCA (1/Title, M. Marzian) - Make title amendment.

     HFA (1, T. Feeley) - Amend sections of KRS 311.864 to 311.890 to allow all certified surgical assistants to work for and to be overseen by dentists and dental surgeons licensed under KRS Chapter 313.
