AN ACT relating to on-site sewage disposal system permits.
Amend KRS 211.350 to provide a 15-day timeline for local health departments to respond to requests for on-site sewage disposal system evaluations and permit approval and require them to provide owners with information necessary to obtain permits, and forward permit evaluation and permit documentation to the Natural Resources and Environmental Protection Cabinet if a surface discharge is involved; amend KRS 211.380 to provide for 15-day response to requests for alternative systems if site fails to meet criteria for septic tank system and the system requires surface discharge; require local health departments to forward documentation to agency providing permits for systems involving surface discharge; amend KRS 318.134 to provide 15-day timeline for response to requests for plumbing installation permits; amend KRS 318.160 to require department to notify an applicant of approval or disapproval of plans within 15 days.
HB 190 - AMENDMENTS
HFA (1, H. Collins) - Retain original provisions except in KRS 211.350 to change the requirement to issue a permit within 15 days to a requirement to issue or deny a permit within 15 days; and change the provision to clarify that a perk test must be required prior to determining that an alternative system is needed and by allowing an extra 10 days, in addition to the 15-day requirement, to make a determination when a consultation with the Department of Public Health is require; and increase from 15 days to 20 days the time requirement for approval or denial of permit for a system having a surface discharge.
