SB 160 (BR 1312) - E. Tori, D. Seum
AN ACT relating to health care.
Amend KRS 311.800 to prohibit certain discriminatory practices against pharmacists who refuse to participate or cooperate in abortions on moral, religious, or professional grounds.
SB 160 - AMENDMENTS
SCS - Retain original provisions except delete all new language in subsections (1) and (2) of Section 1 identifying the type of facilities prohibited from performing abortions and delete new language in subsection (5)(b) specifying the type of disciplinary action prohibited against persons for their willingness or refusal to perform or participate in abortions.
SFA (1, J. Pendleton) - Amend to require pharmacies to post a notice to patients regarding pharmacist's right to refuse to dispense any medication or device that may terminate a pregnancy; establish requirements for the notice; require pharmacists who object to dispensing any medication or device to refer the patient to another provider; and prohibit a pharmacist or pharmacy from refusing to dispense a medication or device that may terminate a pregnancy if an emergency exists.
SFA (2, D. Karem) - Delete original provisions; create a new section of KRS Chapter 315 to exempt a pharmacist who objects to dispensing medications or devices whose primary purpose is to terminate a pregnancy from liability; and prohibit discrimination against a pharmacist who objects to dispensing medications or devices whose primary purpose is to terminate a pregnancy.
SFA (3, J. Denton) - Delete original provisions; create a new section of KRS Chapter 315 to exempt a pharmacist who objects to dispensing medications or devices whose primary purpose is to terminate a pregnancy from liability; and prohibit discrimination against a pharmacist who objects to dispensing medications or devices whose primary purpose is to terminate a pregnancy.
SFA (4, E. Tori) - Amend to include the use of RU-486 in abortion procedures.
SFA (5, J. Pendleton) - Amend to create a new section of KRS Chapter 214 to permit a registered nurse, an advanced registered nurse, or a physicians assistant to dispense approved drugs when acting within the scope of practice and as an agent of a local health department or charitable health care provider, and declare an emergency.

SFA (7, E. Tori) - Amend to specify definition of abortion as applied to pharmacists.
HFA (1, M. Marzian) - Prohibit discrimination against a pharmacist who refuses based upon religious or moral objection to dispense Viagra or other prescription medication for the treatment of penile erectile dysfunction; and create a new section of KRS Chapter 315 to require a valid prescription for Viagra or any other prescription medication for the treatment of penile erectile dysfunction to have the diagnosis written on the face of the prescription and signed by the practitioner acting in the usual course of his professional practice, and limit prescription for only those diagnoses approved by the Food and Drug Administration or listed on the manufacturer's labeling; limit dispensing to a husband who is present with his wife at time of dispensing, and who presents a certified copy of the marriage certificate and a copy of the King James Version of the 7th Commandment prohibiting adultery and who professes allegiance to this prohibition, who presents a valid state photographic identification that corresponds to the husband and wife to whom the medication is to be dispensed, and who is personally known by the pharmacist or whose address can be verified as being closest in geographic proximity to the pharmacist dispensing the medication; and require the pharmacist to counsel the persons receiving the medication about its proper usage, and maintain a list of referral sources for treatment of chronic pain and pain management.
