AN ACT relating to anhydrous ammonia.
Amend KRS 250.482 relating to definitions for the anhydrous ammonia regulation program, to define "approved container"; amend KRS 250.483 relating to anhydrous ammonia regulations to specify that the Department of Housing, Building and Construction, not the Department of Insurance, regulates the program and remove requirement for public hearing prior to adopting administrative regulations; create a new section of KRS Chapter 250 to prohibit possession of anhydrous ammonia in an unapproved container as a Class D felony; create a new section of KRS Chapter 250 to prohibit tampering with facilities storing or transporting anhydrous ammonia as a Class D felony; create a new section of KRS Chapter 250 to limit liability of anhydrous ammonia facilities which have been tampered with; amend KRS 250.991 to provide penalties for possession of anhydrous ammonia in an unapproved container and for tampering with anhydrous ammonia facilities; amend KRS 514.030 relating to theft by unlawful taking to make theft of anhydrous ammonia a Class D felony; amend KRS 514.110 relating to possession of stolen property to make possession of stolen anhydrous ammonia a Class D felony.
HB 501 - AMENDMENTS
HCA (1, R. Thomas) - Clarify the conditions under which a person would be guilty of tampering with anhydrous ammonia equipment.
SCS/LM/CI - Increase the penalty for each offense from a Class D felony to a Class B felony for the first offense and a Class A felony for each subsequent offense if it is proven that the defendant intended to manufacture methamphetamine in violation of KRS 218A.1432; require anhydrous ammonia wholesalers, dealers, and handlers to register with the Department of Housing, Building, and Construction rather than to become licensed.
