HB 115/LM (BR 351) - J. Wayne, Ro. Adams, J. Crenshaw, R. Crimm, P. Marcotte, M. Rader, S. Riggs, J. Thompson
AN ACT relating to public safety.
Create a new section of KRS Chapter 198B to establish definitions for purposes of bleacher seating safety; require public accommodations using bleachers that have open spaces over 30 inches above the grade or floor to have no more than 4 inches of open space between the bleacher footboard, seat, and guardrails, or the installation of an approved safety net; require vertical perimeter guardrails; require existing bleachers to comply no later than July 1, 2001; require new bleachers to comply on the effective date on this act; require inspections every 5 years and structural inspections every 10 years; amend KRS 198B.040 to conform; create a $200,000 fund for compliance grants; impose a civil penalty of $500 for each violation; cite as the "Bleacher Safety Act".
HB 115 - AMENDMENTS
HCS/LM - Retain original provisions of the bill with the following changes; "Bleacher" definition, exempt bleachers with backrests, and continuous tiered or stepped vertical structures with no open spaces; "Place of public accommodation" definition, includes outdoor ball fields; reduce open space limit to three and one-half inches rather than four inches, and require compliance with this Act or the Kentucky Building Code or whichever is more stringent; the requirement for existing bleachers to show proof of compliance is extended to July 1, 2003; require compliance of new bleachers to comply with this Act or the Kentucky Building Code or whichever is more stringent; delete the $200,000 funding for the grant program.
HFA (1/LM, J. Wayne) - Amend to make open spaces between the bleacher footboards, seats, and guardrails four (4) inches instead of three and one-half (3 1/2) inches; allows the state fire marshal to inspect bleachers for compliance.
HFA (2, T. Feeley) - Amend to exempt bleachers 60 inches and lower.
HFA (3/LM, J. Wayne) - Amend to exempt bleachers sixty (60) inches and lower; increase allowable open space between bleacher footboards, seats, and guardrails to four (4) inches instead of three and one-half (3 1/2) inches; allows the state fire marshal to inspect bleachers for compliance; make technical changes.
HFA (4, J. Wayne) - Amend KRS 157.420 to enable school districts to use capital outlay funds, regardless of approved facilities plan, to comply with the Bleacher Safety Act; amend KRS 157.440 to enable school districts to use funds available through the Facilities Support Program of Kentucky to comply with the Bleacher Safety Act regardless of approved facilities plan.
SCS/LM - Retain original provisions of the bill with the following changes made to the GA Copy; require public accommodation using bleachers over 60 inches above grade of the floor to conform to specified safety requirements; require new bleachers manufactured, installed, sold or distributed in the State after the effective date of this Act to comply with safety requirements; require all bleachers, footboards and guardrails to be inspected every 5 years by qualified and certified building inspector, the state fire marshall, or a state licensed design professional and certify that the bleachers have been inspected and are in compliance with sections 1 to 5 of this Act; delete sections 7 and 8 of the bill.
