908 KAR 3:120. Policies and procedures of Western State Hospital.

      STATUTORY AUTHORITY: KRS 194.050, 202A.191, 202B.060, 210.010, 210.040, 210.045, 210.055, 210.285, 42 C.F.R. 440-489, EO 2004-726

      NECESSITY, FUNCTION, AND CONFORMITY: EO 2004-726, effective July 9, 2004, created the Cabinet for Health and Family Services and placed the Department for Mental Health and Mental Retardation within the cabinet. KRS 210.010, relating to the hospitalization of mentally ill and mentally retarded persons, directs that the Secretary for the Cabinet for Health and Family Services shall adopt rules and administrative regulations which insure proper administration and enforcement of these chapters.
