NECESSITY, FUNCTION, AND CONFORMITY: KRS 304.2-110 provides that the Executive Director of the Office of Insurance may make reasonable rules and administrative regulations necessary for or as an aid to the effectuation of any provision of the Kentucky Insurance Code. This administrative regulation allows agents to use an assumed name under specified conditions.
Section 1. Individual Agents. No license shall be issued in an agent's assumed name unless such agent first furnishes the Office of Insurance with a certified copy of the certificate required under KRS 365.015 indicating that such certificate has been filed in the office of the county clerk of each county in which such agent intends to conduct or transact business.
Section 2. Corporate or Partnership Agents. No license shall be issued in an agent's assumed name unless such agent first furnishes the Office of Insurance with certified copies of the certificates required by KRS 365.015 indicating that such certificates have been filed with the Secretary of State and the county clerk of each county in which such agent intends to conduct or transact business.
