      NECESSITY, FUNCTION, AND CONFORMITY: There is no specific provision enabling a retail package or retail drink licensee to use their own truck in transporting alcoholic beverages. This administrative regulation permits retail package or retail drink licensee the limited privilege of transporting, by his own truck, distilled spirits and wine from express or freight depots nearest his premises to the premises themselves. This enables a licensee, if feasible, to do his own limited transportation and thereby save the cost of hiring such transportation by a commercial transporter.


      Section 1. Any person issued a retail package or retail drink license under KRS 243.030, shall be permitted to transport distilled spirits and wine only from the express and the freight depots located nearest said licensee's premises to such licensee's premises, and from such licensee's premises to the nearest freight and express depots. Trucks, wagons, or vehicles in which a retailer or transports distilled spirits and wine shall be governed by the same rules relating to signs as applicable in the case of all other licensees authorized to transport such beverages and as set forth in 804 KAR 8:050.
