804 KAR 8:030. Boatlines' qualifications.

      STATUTORY AUTHORITY: KRS 241.060

      NECESSITY, FUNCTION, AND CONFORMITY: KRS 243.200, authorizing a license for the transportation of distilled spirits and wine, and KRS 243.210 authorizing transportation of malt beverages, make no provision for transportation by boatlines or river transportation. To authorize such transportation, if desired by the distiller or brewer, this administrative regulation extends the same transporting privilege to boat or barge lines.

 

      Section 1. Steam, diesel, or gasoline boatlines, desiring to haul alcoholic beverages in barrels or in unbroken case lots, shall be eligible to be licensed on the same terms and under the same restrictions as are provided for transporters license in KRS 243.030(8) and related sections of the Kentucky Revised Statutes. Provided, however, that such steam, diesel, or gasoline boatline may be licensed only in the event it maintains published river-rail rates, but such licensees shall not be restricted to routes covered by such river-rail rates.
