      804 KAR 8:020. Transporters' license.

 

      RELATES TO: KRS 243.200

      STATUTORY AUTHORITY: KRS 241.060

      NECESSITY, FUNCTION, AND CONFORMITY: This administrative regulation provides specific qualifications and uses of the transporter's license authorized for issuance by KRS 243.200. The requirements are self explanatory and are provided to control the delivery of distilled spirits to persons not authorized to receive such alcoholic beverages.

 

      Section 1. (1) No person, firm or corporation operating motor vehicles for hire over the highways of this state, under authority of a Certificate of Convenience and Necessity issued by the Transportation Cabinet, covering the same territory or highways designated in the certificate as irregular common carrier issued by the Interstate Commerce Commission shall be authorized or permitted to transport any alcoholic beverages in this state until such carrier shall have procured an appropriate transporter's license from the office[department] of Alcoholic Beverage Control, and filed therewith a statement of the proposed route of such territory over which the carrier proposes to transport such beverages.

      (2) Such statement of route must be accompanied by an exhibit consisting of Kentucky road map with the proposed route clearly indicated through by suitable marking.

      (3) Such proposed route shall be restricted to designated federal highways except as to access sideroads to distilleries and terminals, which sideroads must be nearest and most traveled route from distillery to the designated federal highway, and in no instance be more than seven (7) miles from such federal highways.

      (4) Where such carrier has obtained a liquor transporter's license from the office[department] of Alcoholic Beverage Control for transportation over designated routes, pursuant to a regular common carrier certificate, no additional license shall be required upon filing of the designated routes and exhibit required herein.

      (5) Said license will be issued to person legally transporting such alcoholic beverages to allow transportation thereof over numbered Kentucky state highways, or officially prescribed detours thereof. (ABC 8:20; 1 Ky.R. 845; eff. 5-14-75.)
