804 KAR 5:030. Personnel prohibitions.

      NECESSITY, FUNCTION, AND CONFORMITY: In addition to the specific prohibitions contained in KRS 244.090, pertaining to personnel used in the conduct of the business where alcoholic beverages are sold, the second paragraph of this administrative regulation prohibited any person under the age of twenty (20) years from performing any duties in connection with alcoholic beverages on the licensed premises. However, by House Bill No. 444, effective June, 1974, a new section to KRS 244.090 was added, which allows persons eighteen (18) years of age or over to be employed to stock, arrange displays, accept payment for, and sack malt beverages by the package, under the supervision of an adult. It should be noted that the new legislation only pertains to malt beverage licensees, and therefore, does not affect the existing twenty (20) year old prohibition applicable to all other licensees.

 

      Section 1. (1) A licensee who operates another business on the same premises as his alcoholic beverage business shall be prohibited from employing in such business any person barred by KRS 244.090.

      (2) Persons at least eighteen (18) years of age may stock, arrange displays, accept payment for and sack malt beverages by the package, under the supervision of an adult. Delivery of malt beverages away from the parking area of the licensed business premises shall not be performed by anyone under the age of twenty (20) years.

      (3) A retail licensee who operates another business on the same premises may employ a person under the age of twenty (20) years. The person employed shall not perform any duties in connection with alcoholic beverages.

      (4) Any licensee who knowingly employs any person to work as hereinabove prohibited or who shall permit or allow any person with or without his knowledge or consent to so work, shall, upon conviction be subject to the penalty provided in KRS 243.490.
