804 KAR 5:020. Unemployable persons.

      NECESSITY, FUNCTION, AND CONFORMITY: Since KRS 244.240 contains specific prohibitions against distillers, rectifiers, vintners, or wholesalers having any interest in retail premises, this administrative regulation makes clear that cross employment or coemployment shall not be engaged in by any distiller, rectifier, vintner, wholesaler, brewer, or distributor, nor any retail licensee.

      Section 1. (1) No distiller, rectifier, vintner, wholesaler, brewer or distributor shall employ any person in connection with sales or deliveries, who is also an employee of any retail licensee.

      (2) No retail licensee shall employ any person who is also an employee of any distiller, rectifier, vintner, wholesaler, brewer or distributor. (ABC 4:20; 1 Ky.R. 841; eff. 5-14-75.)
