      804 KAR 4:180. Freight forwarders.

      STATUTORY AUTHORITY: KRS 241.060

      NECESSITY, FUNCTION, AND CONFORMITY: KRS 243.200 provides for transportation of distilled spirits by a common carrier but does not specifically provide for the loading, unloading, and temporary custody of distilled spirits by a freight forwarder or warehouseman, which may be necessitated by the transfer from one (1) truck to another of the distilled spirits. This administrative regulation authorizes such freight forwarder to receive, hold, and reship the distilled spirits and wine by common carriers licensed by this office[department]. The fee for the herein license appears in KRS 243.030(22).

      Section 1. A distilled spirits and wine freight forwarder's license shall be granted by the administrator of the distilled spirits unit and shall authorize the licensee to receive from and tender to transporters duly licensed under KRS 243.200, such distilled spirits and wine as are consigned to licensees under KRS 243.020, in the Commonwealth of Kentucky.
