804 KAR 4:140. Distributor's storage.

      STATUTORY AUTHORITY: KRS 241.060

      NECESSITY, FUNCTION, AND CONFORMITY: KRS 243.040 authorizes a distributor's storage license for malt beverages. This administrative regulation provides for the issuance of a special storage license to a beer distributor for the purpose of storage of malt beverages of any type. The fee for the license appears in KRS 243.040.

      Section 1. (1) The malt beverage administrator is hereby authorized to issue a storage license to an applicant who holds a regular distributor's beer license issued by the Commonwealth of Kentucky.

      (2) The licenses shall expire on the last day of a month assigned to the licensee by the office under KRS 243.090.

      Section 2. The malt beverage administrator is hereby authorized to issue a temporary storage license to an applicant who holds a regular distributor's beer license issued by the Commonwealth of Kentucky for storage of beer if there is an emergency. The malt beverage administrator shall have sole discretion to determine the existence of any emergency.
