      804 KAR 4:130. Beer storage.

 

      RELATES TO: KRS 243.040, 243.090

      STATUTORY AUTHORITY: KRS 241.060

      NECESSITY, FUNCTION, AND CONFORMITY: KRS 243.040 authorizes a special off-premises retail storage license for those instances in which it is impossible for a retail beer licensee to store, on his own premises, the supply of beer necessary to operate his premises. This administrative regulation permits a retail beer licensee to apply for an off-premises special storage license. The fee for the license appears in KRS 243.040.

 

      Section 1. (1) The malt beverage administrator is hereby authorized to issue a storage license to applicants who hold a regular retail beer license issued by the Commonwealth of Kentucky; if the application for the storage license accurately describes the location of the storage warehouse to be used by the retailer who is applying for the license.

      (2) The licenses shall expire on the last day of a month assigned to the licensee by the office[department] under KRS 243.090.

      (3) The holder of a special storage license may store malt beverages in a warehouse convenient to his regular retail beer licensed premises and to transport the malt beverages as belonging to the holder of the license to and from the warehouse by way of the nearest route to his regular licensed retail beer premises, if he sells no beer except at his regular beer licensed premises.

      (4) A special storage license may be suspended or revoked for any violation of the alcoholic beverage control law or a violation of any of the administrative regulations issued thereunder, or for the violation of any other law, which would subject a regular license to a suspension or revocation. Proceedings relative to revocation or suspension shall be the same as those provided for other licenses under the alcoholic beverage control law of Kentucky, pursuant to KRS Chapter 13B.
