NECESSITY, FUNCTION, AND CONFORMITY: KRS 151B.025(7) designates the Department for Technical Education as the sole state agency for developing and approving state plans required by federal law as prerequisites to receiving federal funds for vocational-technical or technology education. EO 2000-990 abolished the State Board for Adult and Technical Education and transferred the board’s duties and functions to the department. It also authorized the department to promulgate administrative regulations to implement federal vocational education programs. 20 USC 2342(a)(1) requires the state agency to prepare a state plan for vocational and technical education as a prerequisite to receiving federal funds under 20 USC Chapter 44. This administrative regulation establishes and incorporates by reference the 2001-2004 Kentucky State Plan for Vocational Technical Education.
Section 1. Pursuant to the authority vested in the Department for Technical Education, the 2001-2004 Kentucky State Plan for Vocational Technical Education is hereby prepared and approved in accordance with 20 USC 2301 through 2415, the Carl D. Perkins Vocational and Technical Act of 1998, and submitted to the U.S. Secretary of Education for approval. This document shall be referred to as the Kentucky State Plan for Vocational Technical Education.
Section 2. Incorporation by Reference. (1) The 2001-2004 Kentucky State Plan for Vocational Technical Education, May 1, 2000, is incorporated by reference.
