      STATUTORY AUTHORITY: KRS 171.450

      NECESSITY, FUNCTION, AND CONFORMITY: KRS 171.450(1)(a) requires the department to establish procedures for the compilation and submission to the department of lists and schedules of public records proposed for disposal. KRS 171.450(2) requires the department to enforce the provision of KRS 171.410 to 171.740 by promulgating administrative regulations. This administrative regulation identifies schedules of public records approved and authorized for use by state and local agencies.

      Section 1. Schedules. (1) A Kentucky state government agency shall comply with:

      (a) The General Schedule for State Agencies;

      (b) The General Schedule for Electronic and Related Records; and

      (c) The applicable schedule for the specific agency from among the following:

      1. Department of Agriculture Schedule:

      2. Auditor of Public Accounts Schedule;

      3. Commerce Cabinet Schedule;

      4. Economic Development Schedule;

      5. Education Cabinet Schedule;

      6. Environmental and Public Protection Cabinet Schedule;

      7. Finance and Administration Cabinet Schedule;

      8. General Government Schedule;

      9. Office of the Governor Schedule;

      10. Cabinet for Health and Family Services Schedule;

      11. Justice and Public Safety Cabinet Schedule;

      12. Department of Law Schedule;

      13. Legislative Branch Schedule;

      14. Office of the Lieutenant Governor Schedule;

      15. Personnel Cabinet Schedule;

      16. Office of the Secretary of State Schedule;

      17. Transportation Cabinet Schedule; or

      18. Department of the Treasury Schedule.

      (2) State universities and the Kentucky Community and Technical College System shall comply with the State University Model Schedule.

      (3) Kentucky local government agencies shall comply with:

      (a) The Local Government General Records Schedule;

      (b) The General Schedule for Electronic and Related Records; and

      (c) The applicable schedule for the specific agency from among the following:

      1. Area Development District Schedule;

      2. County Attorney Schedule;

      3. County Clerk Schedule;

      4. County Coroner Schedule;

      5. County Judge Executive Schedule;

      6. County Sheriff Schedule;

      7. County Treasurer Schedule;

      8. Jailer Schedule;

      9. Lexington Fayette Urban County Government Schedule;

      10. Library District Schedule;

      11. Local Health Department Schedule;

      12. Municipal Government Schedule; or

      13. Public School District (K-12/Central Office) Schedule.
