601 KAR 40:010. Identification of motor vehicles transporting municipal solid waste.

      NECESSITY, FUNCTION, AND CONFORMITY: This administrative regulation sets forth the specific requirements for the placard identification of motor vehicles transporting municipal solid waste which are operating in the Commonwealth of Kentucky. This administrative regulation is needed because the motor carrier industry has an unwritten concept of "placard" which appears to be more stringent than the requirements of KRS 174.450.

 

      Section 1. Definitions. "Placard" means any method chosen by the motor vehicle owner to display the words "solid waste" on the motor vehicle. Examples of a placard include paint, magnetic letters, magnetic signs, or other removable device, if that device meets the identification and legibility requirements of this administrative regulation.

 

      Section 2. Size, Shape and Color of the Placard. (1) The placard shall be in letters that contrast sharply in color with the background on which they are placed.

      (2) The placard shall be in all capital letters and readily legible, during daylight hours from a distance of fifty (50) feet while the vehicle is stationary.

      (3) The placard shall be kept and maintained in a manner that retains the legibility requirements of subsection (2) of this section.

 

      Section 3. Placement of the Placard. KRS 174.450(10) specifies the placement of the placard on the motor vehicle. The list of locations shall not be interpreted to include any location on the motor vehicle where the placard is not clearly visible such as the rear of the power unit of the motor vehicle if the power unit is hauling a trailer or semitrailer.
