601 KAR 9:010. Motor carrier vehicle registration if paying seat taxes.

      NECESSITY, FUNCTION, AND CONFORMITY: This administrative regulation establishes guidelines for purchase or transfer of a motor vehicle license plate for motor carriers governed by both KRS 281.720 and either KRS 186.276 or 186.281. U-drive-it vehicles are governed by 601 KAR 1:145.


      Section 1. Evidence of Ownership of Motor Carrier Vehicles Paying Seat Taxes. (1) Any person desiring to obtain any license plate for a bus, taxicab, limousine, airport shuttle vehicle, city bus, industrial bus, or suburban bus operated pursuant to a certificate of public convenience and necessity issued by the Department of Vehicle Regulation shall submit to the department a certificate of title or other satisfactory evidence of ownership of the motor vehicle to be licensed.

      (2) The vehicle shall not be licensed unless the certificate of title or other satisfactory evidence of ownership indicates that the person applying for the license plate is the owner or lessee of the vehicle.


      Section 2. Disposition of License Plate Upon Sale or Transfer of Vehicle. When any motor vehicle licensed by the department as required by either KRS 186.276 or 186.281 is sold or transferred to a person who is the present holder of a valid certificate or permit, and who intends to operate the motor vehicle as a for-hire passenger carrier and consistent with his certificate or permit, a license plate may, upon approval by the department, be transferred to the purchaser or lessee. The transferee of the vehicle and license plate shall not commence operation of the motor vehicle bearing the license plate before notifying the department of the transfer and obtaining approval of the department.


      Section 3. Transfer of License Plate. A person shall not transfer a license plate issued by the department pursuant to KRS 186.276 or 186.281 and 281.720 from one (1) motor vehicle to another without prior approval of the department.
