STATUTORY AUTHORITY: KRS 13A.350, 441.055
NECESSITY, FUNCTION, AND CONFORMITY: KRS 441.055 requires the Department of Corrections to promulgate administrative regulations establishing minimum standards for detention facilities. This administrative regulation sets forth the procedure for the classification of residents.
Section 1. Procedures. (1) Each center shall develop an appropriate resident classification system, which shall be included in the facility's written policy and procedure manual.
(2) The center shall establish guidelines for admission to the facility and a procedure for transfer to the jail from this facility.
(3) The resident classification system shall provide for the separation of male and female residents.
(4) Program evaluation of each resident by a staff no less than once per month and, whenever there is a change in the resident's status.
(5) The classification system shall prohibit discrimination or segregation based on race, color or national origin.
(6) There shall be a procedure for an appeal by the resident of his classification. (13 Ky.R. 826; eff. 11-11-86.)
