NECESSITY, FUNCTION, AND CONFORMITY: KRS 224.10-100(28) authorizes the Environmental and Public Protection Cabinet to promulgate administrative regulations. EO 2008-507 and 2008-531, effective June 16, 2008, abolish the Environmental and Public Protection Cabinet and establish the new Energy and Environment Cabinet. This administrative regulation defines essential terms that are used in 401 KAR Chapter 37. Some federal terms have been modified to conform to Kentucky statutory mandates. Definitions contained in KRS Chapter 224 have been referenced to the appropriate statutory citation. Some terms do not have a federal counterpart and have been added to clarify requirements and provisions of KRS Chapter 224 and 401 KAR Chapter 37.
Section 1. Definitions. Except as provided in this section, the definitions established in 40 C.F.R. 260.10, effective September 9, 2005, shall apply.
(1) "Administrator", "agency", "assistant administrator", "regional administrator", "director", or "regional director" means the Energy and Environment Cabinet, pursuant to EO 2008-507 and 2008-531, effective June 16, 2008.
(2) "Application" means the form approved by the cabinet for applying for a permit, including additions, revisions, or modifications and narrative or drawings, if required by 401 KAR Chapters 30 to 48, and includes Part A of the application (Part A), Part B of the application (Part B), notice of intent, administration application, special waste application, or technical application.
(3) "Burn" means burning for energy recovery or destruction, or processing for materials recovery or as an ingredient.
(4) "Cabinet" is defined by KRS 224.01-010(9), EO 2008-507 and 2008-531 reorganized the Environmental and Public Protection Cabinet as the Energy and Environment Cabinet, effective June 16, 2008.
(5) "Debris" is defined by 40 C.F.R. 268.2(g).
(6) "Disposal" is defined by KRS 224.01-010(10).
(7) "Environmental Protection Agency" or "EPA" means the Kentucky Department for Environmental Protection except if used in the phrases "EPA hazardous waste number", "EPA identification number", "EPA Region", "EPA Acknowledgment of Consent", "EPA Test Methods", or "EPA publications".
(8) "EPA Region or Authorized State" means the Commonwealth of Kentucky in 401 KAR 37:010, Section 8, where 40 C.F.R. 268.9(d) is referenced.
(9) "Federal Register" means the "Kentucky Administrative Register" as described in KRS 13A.050.
(10) "Generator" is defined by KRS 224.01-010(13).
(11) "Halogenated organic compounds" means those compounds having a carbon-halogen bond that are listed under 401 KAR 37:060, Section 1.
(12) "Hazardous constituent" is defined by KRS 224.01.010(42).
(13) "Hazardous debris" means debris that contains a hazardous waste listed in a federal regulation cited in 401 KAR 31:040 or that exhibits a characteristic of hazardous waste identified in 401 KAR 31:030.
(14) "Hazardous waste" is defined by KRS 224.01-010(31)(b).
(15) "Inorganic metal bearing waste" means waste for which EPA has established treatment standards for metal hazardous constituents, and which does not otherwise contain significant organic or cyanide content as described in 401 KAR 37:010, Section 3, and is specifically listed in 401 KAR 37:060, Section 7.
(16) "Lab pack" means a large container equal to or smaller than fifty-five (55) gallons that holds many smaller containers of various content tightly secured with packing material.
(17) "Land disposal" is defined by KRS 224.01-010(43).
(18) "LDR" means land disposal restrictions.
(19) "Manifest" is defined by KRS 224.01-010(37).
(20) "Nonwastewaters" means waters that do not meet the criteria for wastewaters in subsection 1(33) of this section.
(21) "Person" is defined by KRS 224.01-010(17).
(22) "Polychlorinated biphenyls" or "PCBs" means halogenated organic compounds defined in accordance with 40 C.F.R. 761.3.
(23) "Publicly owned treatment works" or "POTW" is defined by KRS 224.01-010(19).
(24) "Soil" is defined by 40 C.F.R. 268.2(k).
(25) "Solid waste" is defined by KRS 224.01-010(31)(a).
(26) "Storage" is defined by KRS 224.01-010(28).
(27) "Transfer facility" is defined by KRS 224.01-010(48).
(28) "Transportation" is defined by KRS 224.01-010(29).
(29) "Treatment" is defined by KRS 224.01-010(30).
(30) "Underlying hazardous constituents" means a constituent listed in 401 KAR 37:040, Section 9, Table UTS - Universal Treatment Standards, except fluoride, selenium, sulfides, vanadium, and zinc, which may reasonably be expected to be present at the point of generation of the hazardous waste at a concentration above the constituent-specific UTS treatment standards.
(31) "United States" means the Commonwealth of Kentucky.
(32) "Used oil" is defined by KRS 224.50-545(2)(a).
(33) "Wastewaters" means wastes that contain less than one (1) percent by weight total organic carbon (TOC) and less than one (1) percent by weight total suspended solids (TSS), with the following exceptions:
(a) F001, F002, F003, F004, F005, wastewaters are solvent-water mixtures that contain less than one (1) percent by weight TOC or less than one (1) percent by weight total F001, F002, F003, F004, F005 solvent constituents listed in 401 KAR 37:040, Section 2 in Table Treatment Standards for Hazardous Waste;
(b) K011, K013, K014 wastewaters contain less than five (5) percent by weight TOC and less than one (1) percent by weight TSS, as generated; and
(c) K103 and K104 wastewaters contain less than four (4) percent by weight TOC and less than one (1) percent by weight TSS.
(34) "Water" or "Waters of the Commonwealth" is defined by KRS 224.01-010(33).
