401 KAR 34:340. Appendix on political jurisdictions and demonstration of compliance with the seismic standards.

      RELATES TO: KRS 224.10, 224.40, 224.46

      STATUTORY AUTHORITY: KRS 224.10-100, 224.46-505, 224.46-520

NECESSITY, FUNCTION, AND CONFORMITY: KRS 224.46-520 requires that persons engaging in the storage, treatment, and disposal of hazardous waste obtain a permit. KRS 224.46-520 requires the cabinet to establish standards for these permits, to require adequate financial responsibility, to establish minimum standards for closure for all facilities and the postclosure monitoring and maintenance of hazardous waste disposal facilities. This chapter establishes minimum standards for new hazardous waste sites or facilities. This administrative regulation identifies those counties which must have compliance with the seismic standards demonstrated before siting a hazardous waste site or facility.

Section 1. Political Jurisdictions in which Compliance with Section 9(1) of 401 KAR 34:020 Must be Demonstrated. If the proposed hazardous waste site or facility is within one (1) of the following counties, compliance with Section 9(1) of 401 KAR 34:020 must be demonstrated unless the cabinet has issued a variance pursuant to 401 KAR 30:020, Section 2.

(Note: On November 23, 1981, the administrator issued an interim final rule which deleted those counties. A final rule by the administrator excluding the Kentucky counties would be grounds for the granting of a variance.) (Recodified from 401 KAR 2:063, Section 22(2), 3-1-83.)
