301 KAR 1:155. Commercial fishing requirements.

STATUTORY AUTHORITY: KRS 150.025(1)
NECESSITY, FUNCTION, AND CONFORMITY: KRS 150.025(1) authorizes the department to promulgate administrative regulations governing the methods and devices used to take wildlife, as well as the buying and selling of wildlife. The function of this administrative regulation is to regulate the taking of fish for commercial use, to avoid conflicts with other interests, and to utilize and conserve these fish populations.
Section 1. Definitions. (1) "Bar mesh size" is defined in 301 KAR 1:140.
(2) "Commercial fisherman" means a person holding a valid resident or nonresident commercial fishing license.
(3)[(2)] "Commercial fishing
gear" means the equipment described in 301 KAR 1:146.
(4) "Dealer permit" means a commercial roe fish dealer permit.
(5) "Documented unlicensed helper" is the person listed as the unlicensed helper on the application for the commercial roe fish harvester permit for the purposes of transferability.
(6) "Harvester permit" means a commercial roe fish harvester permit.
(7)[(6)][(3)]
"Overflow lake" means a permanent or temporary body of water that
receives overflow flood waters from an adjacent stream.
(8)[(7)]
"Roe fish" means paddlefish, shovelnose sturgeon, and bowfin.
(9) "Roe fish transportation card" means a card issued in the name of the harvester permittee that allows an unlicensed helper, with the card in possession, the ability to transport and sell legally caught roe fish or roe in the absence of the harvester permittee.

"Sport fish" means those species so designated by 301 KAR 1:060.
(11)[(9)][(5)]
"Unlicensed helper" means a person without a commercial fishing
license who is assisting a commercial fisherman.
Section 2. Unlicensed Helpers. (1) A commercial fisherman shall not utilize more than one (1) unlicensed helper while actively fishing.
(2) An unlicensed helper shall be accompanied by a
licensed commercial fisherman while using [not use] commercial
fishing gear or selling fish, except that an unlicensed helper may
legally transport or sell:
(a) Roe fish to a roe fish dealer if the unlicensed helper possesses a valid roe fish transportation car; or
(b) Roe from a fish processing facility to a roe
fish dealer if the unlicensed helper possesses a valid roe fish transportation
card and a bill of lading. [sell fish unless he is accompanied by a licensed
commercial fisherman].
Section 3. Tagging and Using Commercial Gear. A commercial fisherman shall:
(1) Tag commercial fishing gear so that a conservation officer can find and read the commercial gear tag without undue difficulty.
(2) Not use commercial fishing gear:
(a) Within fifty (50) yards of the outlet or inlet of an overflow lake; or
(b) Within fifty (50) yards of the mouth of a stream except the mouth of the Ohio River.
(3) Not use commercial nets from April 1 through October 31:
(a) In bays and inlets of Kentucky or Barkley Lakes; or
(b) Within a distance of 200 yards from the mouth of bays or inlets in Kentucky or Barkley Lakes.
Section 4. Harvester Permit [Requirements].
(1) For the 2008 commercial fishing season:
(a) The department shall sell harvester permits between the dates of July 15 and August 28, 2008 only to:
1. A resident of Kentucky who possesses a valid 2008 commercial fishing license; or
2. A person who possesses a valid nonresident 2008 commercial fishing license and previously:
a. Reported harvesting paddlefish roe or flesh from March 1, 2006 to September 7, 2007; or
b. Purchased a shovelnose sturgeon permit for the 2006-2007 season or 2007-2008 season.
(b) An eligible commercial fisherman as specified in this section shall submit a completed Application for Commercial Roe Fish Harvester Permit along with permit fees as stipulated in 301 KAR 3:022 to the department by August 28, 2008. Mailed applications shall be postmarked no later than August 28, 2008.
(c) The number of harvester permits sold after the 2008 season shall not exceed the number of resident and nonresident harvester permits sold in 2008.
(2) Beginning with the 2009 commercial fishing season:
(a) A person wishing to renew a harvester permit shall possess a valid commercial fishing license and submit a completed Application for Commercial Roe Fish Harvester Permit and permit fees as stipulated in 301 KAR 3:022 to the department by September 30. Mailed applications shall be postmarked by September 30.
(b) A harvester permittee shall be eligible to transfer permit privileges, prior to September 30, to an immediate family member or the documented unlicensed helper of the harvester permittee.
1. The harvester permittee shall send to the department, postmarked by September 30, a notarized letter documenting the name and relationship of the transferee.
2. Transferability shall be voided if a commercial fishing license or harvester permit is revoked or pending revocation as specified in Section 11 of this administrative regulation.
(c) If the number of either resident or nonresident harvester permit applications are lower than the number issued in 2008, the unfilled permits shall be available using methods described in subsection (3) of this section.
(3) Lottery drawings for resident and non-resident harvester permits.
(a) Harvester permits shall not be sold to a resident of a state that will not sell a nonresident roe permit to a Kentucky resident.
(b) A person wishing to apply for an unfilled resident or nonresident harvester permit in the lottery drawings shall submit a completed Application for Commercial Roe Fish Harvester Permit to the department, along with permit fees as stipulated in 301 KAR 3:022 by September 30. Mailed applications shall be postmarked by September 30.
(c) A person chosen in the lottery drawing for an unfilled harvester permit shall obtain a valid commercial fishing license prior to obtaining the harvester permit.
(d) If a person is not chosen in the lottery drawing, permit fees will be returned.
(e) If the department receives fewer nonresident harvester permit applications than the number of available permits, then those unused permits shall convert to resident permits, and shall be placed in the resident harvester permit lottery drawing.
(f) Resident harvester permits not filled following the lottery drawing shall lapse, resulting in a permanent reduction in the total number of harvester permits available.
(4) Harvester permit requirements.
(a) A harvester permit shall be required for a licensed commercial fisherman to harvest and sell roe fish or roe. A harvester permit shall not be required for a special commercial fishing permittee to harvest and sell paddlefish flesh or roe from Kentucky and Barkley lakes during the special commercial fishing season, as stipulated in 301 KAR 1:140.
(b) A harvester permit, as described in subsections (1) and (2) of this section, shall not be issued unless all monthly reports have been completed and submitted to the department as stipulated in Section (10) of this administrative regulation.
(c) A harvester permittee shall:
1. Have the harvester permit in possession while:
a. Fishing for roe fish; and
b. Transporting or selling roe fish or its roe.
2. Be issued a roe fish transportation card in the permit holder’s name.
3. Only sell, ship, barter or provide harvested roe from roe fish to a Kentucky dealer permittee as stipulated in Section 5 of this administrative regulation.
4. Possess a valid bill of lading when transporting processed roe.
5. Complete a Daily Roe Harvester’s Transaction Report for each day that roe fish are harvested or are sold to a Kentucky roe fish dealer. All Daily Roe Harvester’s Transaction Reports that are completed within a calendar month must be submitted to the department by the tenth day of the following month.
6. Complete and submit to the
department a monthly report as stipulated in Section 10 of this administrative
regulation.[A harvester permit shall be required
for a licensed commercial fisherman to harvest roe fish or its roe. A harvester
permit shall not be required for a special commercial fishing permittee to
harvest paddlefish flesh or roe from Kentucky and Barkley lakes during the
special commercial fishing season, as stipulated in 301 KAR 1:140.
(2) A licensed
commercial fisherman, who meets the eligibility requirements in this section
shall apply for a harvester permit by submitting a completed Application for a
Commercial Roe Fish Harvester Permit along with permit fees to the department,
as stipulated in 301 KAR 3:022.
(3) The department shall issue a
harvester permit only to a person who possesses a valid Kentucky commercial
fishing license; and
(a) Reported paddlefish flesh or roe
harvest in Kentucky from March 1, 2006 through September 7, 2007; or
(b) Possessed a shovelnose sturgeon
permit from March 1, 2006 through September 7, 2007.
(4) For the harvester permit season,
as stipulated in Section 6 of this administrative regulation, a commercial
fisherman that is eligible to purchase a harvester permit shall purchase the
harvester permit during the period from July 1, 2008 through September 30,
2008. The department shall use a lottery drawing to issue up to fifteen (15)
additional harvester permits to new applicants who are currently not eligible
to purchase a harvester permit, as stipulated in Section 4(3) of this
administrative regulation.
(a) A person wishing to apply for a
harvester permit in the lottery drawing shall submit a completed Application
for a Commercial Roe Fish Harvester Permit along with permit fees to the
department, as stipulated in 301 KAR 3:022, during the period from July 1, 2008
through September 30, 2008.
(b) The lottery drawing for the
fifteen (15) additional permits shall be made on October 15, 2008.
(c) No more than three (3) of the
fifteen (15) additional harvester permits shall be issued to nonresidents.
(d) Permit fees shall be returned if
a person does not get chosen in the lottery drawing.
(5) The number of harvester permits
issued by the department shall be capped for future years at the total number
of harvester permits issued in 2008 from the process described in subsections (3)
and (4) of this section. New harvester permits shall not be issued until the
total number of harvester permits falls below the cap established in 2008.
(a) A lottery drawing shall be used
to select new harvester permittees once the number of harvester permits issued
has dropped below the cap established in 2008.
(b) Resident commercial fishermen
shall be given first priority in the lottery drawing process for a vacant
resident or nonresident harvester permit.
(c) A person wishing to apply for a
vacant harvester permit shall submit a completed Application for a Commercial
Roe Fish Harvester Permit along with permit fees to the department, as
stipulated in 301 KAR 3:022, on or before October 15 to be included in the
lottery drawing. A harvester permit application mailed to the department shall
be postmarked on or before October 15.
(6) A harvester permittee shall
purchase a harvester permit annually by October 15 to retain their roe fish
harvesting privilege. A harvester permit application mailed to the department
shall be postmarked on or before October 15.
(a) A harvester permittee shall be
eligible to transfer their permit privileges to an immediate family member or a
documented unlicensed helper of the harvester permittee.
(b) A harvester permit transfer
shall occur prior to the October 15 harvester permit season.
(c) Transferability shall be voided
if a commercial fishing license or harvester permit is revoked or pending
revocation as specified in Section 10 of this administrative regulation.
(7) A harvester permittee shall:
(a) Have the harvester permit in
possession while:
1. Fishing for roe fish or its roe;
2. Transporting roe fish or its roe;
and
3. Selling roe fish species or its
roe.
(b) Only sell, ship, barter, or
provide harvested roe from roe fish to a Kentucky dealer permittee as
stipulated in Section 5 of this administrative regulation;
(c) Have in possession a valid bill
of lading when transporting processed roe prior to a transaction with a
permitted dealer;
(d) Complete a Daily Commercial Roe
Harvest Report for each transaction with a permitted dealer and submit to the
department within thirty (30) days of the date of the transaction; and
(e) Submit a completed Monthly
Report of Commercial Fish Harvest in Kentucky, as stipulated in Section 10 of
this administrative regulation to the department.]
Section 5. Dealer Permit Requirements.
(1) A Kentucky dealer permit shall be required to buy, sell, barter, receive,
or ship roe from roe fish harvested in Kentucky [by a person who
possesses a valid Kentucky harvester permit or a special commercial fishing
permit].
(2) A person shall apply for a dealer
permit by submitting a completed Application for [a] Commercial Roe Fish
Dealer Permit along with permit fees to the department, as stipulated in 301
KAR 3:022.
(3) A dealer permittee shall:
(a) Have in possession a valid dealer permit when purchasing, receiving, or transporting roe harvested from a permitted harvester;
(b) Maintain an accurate record of all roe purchased from roe fish harvested in Kentucky;
(c) Submit a completed Monthly Commercial Roe Dealer Report to the department by the tenth day of the following month;
(d) Sign the Daily [Commercial]
Roe Harvester's Transaction[Harvest]
Report for each transaction with a harvester permittee prior to purchasing or
receiving roe from the licensed harvester permittee;
(e) Retain a copy of the Daily [Commercial]
Roe Harvester's Transaction[Harvest]
Report for each transaction with a harvester permittee for a period of three
(3) years; and
(f) Allow a conservation officer to inspect his or her facilities for record keeping and other requirements stipulated in this administrative regulation.
Section 6. Commercial Fishing Season and Size Limits. (1) The commercial fishing season shall be open year round in the waters listed in 301 KAR 1:150 except for:
(a) Kentucky and Barkley lakes as described in 301 KAR 1:140;
(b) The shovelnose sturgeon (Scaphirhynchus platorynchus) season, which shall extend from October 15 through May 15; and
(c) The paddlefish (Polyodon spathula) season, which shall extend from November 1 through April 24.
(2)[A commercial fisherman shall have in his or her possession
a valid commercial fishing license and a commercial shovelnose sturgeon permit
to possess shovelnose sturgeon and their eggs.
(3)] There shall be no size limits
on any commercially-harvested rough fish except that a commercial fisherman
shall only harvest:
(a) Shovelnose sturgeon between twenty-four (24) and thirty-two (32) inches, as measured from the tip of snout to the fork of the tail fin; and
(b) Paddlefish that are thirty-two (32) inches or greater, as measured from the beginning of the eye to the fork of the tail fin, except for Kentucky and Barkley lakes as specified in 301 KAR 1:140.
(3) A harvester permittee [or
a special commercial fishing permittee] shall not possess:
(a) Paddlefish roe for more than five (5) days after the close of the paddlefish season; or
(b) Shovelnose sturgeon roe for more than five (5) days after the close of the shovelnose sturgeon season.
(4) A special net commercial fishing
permittee shall not possess paddlefish roe for more than five (5) days after
the close of the special net season on Kentucky and Barkley lakes as specified
in 301 KAR 1:140[paddlefish or shovelnose sturgeon roe more than five (5)
days after the closure of the paddlefish or shovelnose sturgeon commercial fishing
season or the special commercial fishing season on Kentucky and Barkley lakes
as specified in 301 KAR 1:140].
Section 7. [shovelnose sturgeon
between twenty-four (24) and thirty-two (32) inches, as measured from tip of
snout to the fork of the tail fin.
Section 5.] Fish Species Ineligible for
Commercial Harvest. (1) A commercial fisherman shall not take:
(a) Sport fish listed in 301 KAR 1:060;
(b) Pallid sturgeon (Scaphirhynchus albus), a federally-endangered species; or
(c) Lake sturgeon (Acipenser fulvescens).
(2) If a commercial fisherman [mistakenly]
catches a fish listed in subsection (1) of this section, the fish shall be
immediately returned [he shall immediately return the fish], without
undue injury, to the waters where it was taken.
(3) A licensed commercial fisherman shall not sell paddlefish or shovelnose sturgeon harvested by the following sport fishing methods:
(a) Hook and line in hand;
(b) Rod in hand;
(c) Jugging;
(d) Snagging; and
(e) Sport fishing trotlines.
Section 8.[Section 6.] Tending Gear and
Removing Fish. A commercial fisherman shall:
(1) Tend and remove the fish from:
(a) Baited hoop nets or slat traps at least every seventy-two (72) hours; and
(b) Other commercial fishing gear at least every twenty-four (24) hours.
(2) Not possess eggs of any species of fish outside of the fish's body cavity while on the water or adjacent bank.
(3) Remove commercial fishing gear from the water when finished fishing.
Section 9. Roe Fish [Species]
Egg Checking Methodology. A commercial fisherman shall be allowed to use a ten
(10) gauge needle to examine roe fish for the presence of eggs [as a
legal egg checking methodology].
Section 10.[Section 7.] Reporting. [(1)]
A commercial fisherman shall report his or her monthly catch for all months [that
he or she was] licensed including those when the licensee did not fish to
the department, by the tenth day of the following month, by completing a
Monthly Report of Commercial Fish Harvest in Kentucky form that is provided by
the department.
[(2) The department shall not renew the license of
a commercial fisherman who does not submit a completed Monthly Report of Commercial
Fish Harvest in Kentucky form for each month that he or she was licensed,
including any months when the licensee did not fish.]
Section 11.[Section 8.]
License and Permit Revocation and Nonrenewal. (1) The department
shall not renew the commercial fishing license, harvester permit, or dealer
permit of a person who fails to complete and submit to the department any
reports required by this regulation.
(2) The department shall revoke the commercial fishing license or harvester permit, for a period of two (2) years, of a person who has been convicted of a federal commercial fishing violation or the following state violations involving commercial fishing:
(a)[The department shall revoke
or not renew the commercial fishing license, harvester permit, or dealer permit
for a period of two (2) years of a person who fails to complete and submit
to the department a Monthly Commercial Roe Dealer Report, a Monthly Report of
Commercial Fish Harvest in Kentucky, or a Daily Commercial Roe Harvest Report
for each transaction involving a commercial roe dealer permittee or who] [that] [has
been convicted of a federal commercial fishing violation or the following state
violations involving commercial fishing:
(1)] Use of illegal
commercial gear;
(b)[(2)]
Placement of commercial fishing gear in a restricted area;
(c)[(3)]
Harvesting of prohibited species of fish;
(d)[(4)]
Commercially fishing in waters not open to commercial fishing; or
(e)[(5)]
Nonreporting or falsifying of commercial harvest data.
(3) The department shall revoke the dealers permit, for a period of two (2) years, of a person who:
(a) Has been convicted of a federal commercial fishing violation; or
(b) Has not reported or has falsified data on the Monthly Commercial Roe Dealer Report.
(4) An individual whose permit or license has been denied, revoked or not renewed may request an administrative hearing pursuant to KRS Chapter 13B.

REGULATORY IMPACT ANALYSIS AND TIERING STATEMENT

(1) Provide a brief summary of:
(a) What this administrative regulation does: This administrative regulation specifies legal commercial fishing and reporting requirements.
(b) The necessity of this administrative regulation: This administrative regulation is necessary to effectively manage the fish populations of Kentucky.
(c) How this administrative regulation conforms to the content of the authorizing statutes: KRS 150.025 authorizes the Department of Fish and Wildlife Resources to promulgate administrative regulations necessary to regulate commercial fishing in the Commonwealth of Kentucky.
(d) How this administrative regulation currently assists or will assist in the effective administration of the statutes: This administrative regulation will carry out the purposes of KRS 150.025 by defining the requirements for commercial fishing in the Commonwealth of Kentucky.
(2) If this is an amendment to an existing administrative regulation, provide a brief summary of:
(a) How the amendment will change this existing administrative regulation: This amendment establishes new requirements for commercial fishermen to obtain a commercial roe fish harvester permit and a commercial roe dealer permit. In addition, this amendment eliminates the shovelnose sturgeon permit. This amendment also establishes a paddlefish commercial fishing season from November 1 through April 24. The minimum size limit for paddlefish shall be 32 inches. This amendment also establishes the use of a 10 gauge needle to check for eggs in paddlefish as a legal egg checking methodology. Finally, this amendment clarifies that commercial fisherman shall not sell paddlefish or shovelnose sturgeon harvested by sport fishing methods.
(b) The necessity of the amendment to this administrative regulation: This amendment is necessary for the department to effectively manage the paddlefish and shovelnose sturgeon populations in Kentucky. This amendment establishes a permit process for commercial fishermen and dealers of roe in Kentucky. This amendment also establishes a commercial fishing season for paddlefish. Finally, this amendment clarifies that commercial fishermen shall not sell paddlefish or shovelnose sturgeon harvested by sport fishing methods.
(c) How the amendment conforms to the content of the authorizing statutes: See (1)(c) above.
(d) How the amendment will assist in the effective administration of the statutes: See (1)(d) above.
(3) List the type and number of individuals, businesses, organizations, or state and local governments affected by this administrative regulation: This amendment will affect all commercial fishermen who harvest roe fish. In 2007, there were 326 licensed commercial fisherman. This amendment will also affect all individuals or businesses that purchase or receive roe. There is no current estimate on the number of individuals or businesses that purchase or receive roe in Kentucky.
(4) Provide an analysis of how the entities identified in question (3) will be impacted by either the implementation of this administrative regulation, if new, or by the change, if it is an amendment, including:
(a) List the actions that each of the regulated entities identified in question (3) will have to take to comply with this administrative regulation or amendment: All commercial fishermen who harvest roe fish shall be required to purchase a commercial roe fish harvester permit. In addition, all harvested roe in Kentucky shall be sold only to a licensed commercial roe dealer permittee. Commercial roe fish harvester permittees shall only harvest paddlefish from November 1 through April 24. Commercial fishermen shall not sell paddlefish harvested by sport fishing methods.
(b) In complying with this administrative regulation or amendment, how much will it cost each of the entities identified in question (3): It will cost resident and nonresident commercial fishermen $500 and $1,500, respectively, to purchase a commercial roe fish harvester permit. It will cost resident and nonresident roe buyers $500 and $1,000, respectively, to purchase a commercial roe dealer permit.
(c) As a result of compliance, what benefits will accrue to the entities identified in question (3): By complying with this amendment, the department will be better able to manage the population of roe fish.
(5) Provide an estimate of how much it will cost the administrative body to implement this administrative regulation:
(a) Initially: There will be no cost to the agency as result of this administrative amendment.
(b) On a continuing basis: There will be no cost on a continuing basis.
(6) What is the source of the funding to be used for the implementation and enforcement of this administrative regulation: The source of funding is the State Game and Fish Fund.
(7) Provide an assessment of whether an increase in fees or funding will be necessary to implement this administrative regulation, if new, or by the change if it is an amendment: An increase in fees will not be necessary to implement this administrative regulation. This amendment will establish two new permits and fees and will eliminate one existing permit and fee.
(8) State whether or not this administrative regulation established any fees or directly or indirectly increased any fees: This amendment establishes two new permits and fees; a commercial roe fish harvester permit available to either resident ($500) or nonresident ($1,500) commercial fishermen and a commercial roe dealer permit available to either residents ($500) or nonresidents ($1,000).
(9) TIERING: Is tiering applied?. Yes, tiering was applied. Only non-resident licensed commercial fisherman who either (1) reported paddlefish flesh or roe harvest from March 1, 2006 through September 7, 2007 or (2) purchased a shovelnose sturgeon permit from March 1, 2007 through September 7, 2007 will remain eligible to purchase a commercial roe fish harvester permit. All Kentucky resident commercial fishermen are eligible to apply. Licensed commercial fishermen who do not meet these eligibility requirements or whose name is not chosen during the lottery drawing for vacant harvester permits will not be eligible to harvest roe fish or roe.

The Kentucky Department of Fish and Wildlife Resources Divisions of Fisheries and Law Enforcement will be impacted by this administrative regulation.
3. Identify each state or federal statute or federal regulation that requires or authorizes the action taken by the administrative regulation. KRS 150.025 authorizes the Department to promulgate administrative regulations necessary to properly manage fish populations in Kentucky.

This amendment will generate $500 for each resident commercial roe fish harvester permit and $1,500 for each nonresident commercial roe fish harvester permit sold. Additionally, this amendment will generate $500 for each resident commercial roe dealer permit and $1,000 for each nonresident commercial roe dealer permit sold. Estimated revenue will exceed $75,000.

The amount of revenue will be determined by the number of commercial fishermen who purchase a commercial roe fish harvester permit and by the number of individuals or businesses who purchase a commercial roe dealer permit. Estimated revenue will exceed $75,000 in subsequent years.
(c) How much will it cost to administer this program for the first year? There will be no additional costs incurred for the first year.
