201 KAR 29:015. Fees.

      NECESSITY, FUNCTION, AND CONFORMITY: KRS 325.230(2) requires the board to establish appropriate and reasonable fees and to periodically review and modify those fees. This administrative regulation establishes all fees charged by the board.

 

      Section 1. Application Fees Schedule. The following fees shall be paid in connection with all types of respiratory care applications:

      (1) The application fee for mandatory certification shall be fifty (50) dollars.

      (2) The application fee for temporary mandatory certification shall be fifty (50) dollars.

      (3) The application fee for limited mandatory certification shall be ten (10) dollars.

 

      Section 2. Certification Fees. The following fees shall be paid in connection with all types of respiratory care credentials and in addition to the application fees listed in Section 1 of this administrative regulation.

      (1) The mandatory certification fee shall be seventy-five (75) dollars.

      (2) The temporary mandatory certification fee shall be thirty-five (35) dollars.

      (3) The limited mandatory certification fee shall be forty (40) dollars.

 

      Section 3. Renewal Fees and Penalties. No person holding a mandatory certification shall practice in this state after January 30 of the year in which his certificate is to be renewed unless his certification has been renewed as provided by law and payment of the prescribed fee has been made. All mandatory certificates not renewed by January 30 shall be deemed expired and no person holding an expired certificate shall engage in the practice of respiratory care.

      (1) The following fees and penalties shall be paid in connection with mandatory certification renewals and penalties:

      (a) The renewal fee for mandatory certification shall be seventy-five (75) dollars.

      (b) The reinstatement fee for mandatory certification after January 30 shall be $150.

      (c) The renewal fee for inactive mandatory certification shall be twenty-five (25) dollars.

      (2) Temporary mandatory certification and limited mandatory certification are not subject to renewal.
