HB 353 (BR 447) - De. Butler, T. Kerr, S. Santoro
AN ACT relating to the disclosure of state tax records in criminal prosecutions.
Amend KRS 131.190 to allow the Department of Revenue to divulge state tax records or information pursuant to court orders or subpoenas issued by a court of competent jurisdiction, or by a grand jury, in the prosecution of a state or federal crime.
HB 353 - AMENDMENTS
HFA (1, D. Butler) - Delete original provisions, and instead provide that state tax records or information may be divulged in certain prosecutions of state or federal crimes, pursuant to a search warrant and either a grand jury subpoena, or court order issued by a court of competent jurisdiction provided the court makes a finding that the production of the information is reasonable and necessary to the prosecution of a state or federal crime.
