HB 418/LM (BR 1682) - D. Ford, S. Gregory, R. Palumbo, W. Stone
AN ACT relating to methamphetamine.
Amend KRS 224.01-410 to require a notice of methamphetamine contamination to be filed by the county attorney with the county clerk who attaches the notice to the deed of the property when properties are declared to be contaminated with chemicals used in methamphetamine manufacturing; require a notice of decontamination to be filed when the property is properly cleaned.
HB 418 - AMENDMENTS
HFA (1, D. Ford) - Amend Section 1(9)(b) to provide that the methamphetamine contamination notice is in the form of a lien in favor of the Commonwealth and includes the name and address of the property owner, that payment for the lien is made pursuant to the schedule set out in KRS 64.012(7), and that the lien is submitted pursuant to the cabinet's requirements; provide that when the property is decontaminated that the lien is released with the accompanying fee paid pursuant to KRS 64.012(8) and that the lien remains valid until decontamination is completed.
