AN ACT relating to the protection of disabled children.
Create a new section of KRS Chapter 382 to allow a homeowner to alter or construct a structure on his or her property for the accommodation or therapy of a disabled child, notwithstanding any private property restrictions to the contrary, if the construction or alteration is made upon the advice of a physician and otherwise complies with local, state, and federal law; EMERGENCY.
HB 160 - AMENDMENTS
HCS - Insert provisions to limit the bill to children 12 and under, to limit the structure to 100 square feet or smaller, to specify placement and architectural criteria, to require pre-construction dispute resolution, to establish parameters for the removal of the structure, to prohibit non-therapeutic uses of the structure, and to require disclosure that the structure is a non-conforming structure in a seller’s disclosure of home conditions made in the course of selling the home. HFA (1/Title, R. Henderson) - Make title amendment. HFA (2, G. Stumbo) - Create a new section of KRS Chapter 381 to prevent a homeowners' association from prohibiting the posting or display of the United States flag or of a noncommercial sign, poster, or banner on an owner's separate interest in the property, except as required to protect public safety or to prevent violation of a law or constitutional right; establish allowable restrictions on location, construction, and size of signs, posters, and banners.
